what if i verbally agreed to a injury compensation from insurance company?
i verbally agreed to an injury compensation for my auto accident but they told me to sign paper work to finalize it. i have not signed anything so does that make the agreement void. I started feeling some really bad back and neck pain and they are only offering me a very low amount of money and only two doctor visits. can my attorney do anything for me. the conversation was recorded
the accident happen last wensday and i didnt start feeling the pain till the next morning. they got me to agree on the same day of the accident
No paperwork, no deal.
ask your attorney
It makes the agreement not finalized.
Since you already have an attorney, you need to ask them, if they can do anything for you.
~~Nothing is binding until a contract or release is signed by you.~~
speak to attorney to find out your alternatives
The paperwork they need signed is a release. Most companies until you sign the release will not issue the check to you and your attorney. Tell your attorney that you want to wait at this time. The insurance company will wait. You have up to 2 years from the date of your accident to settle, no hurry.
But with only 2 doctor visits and now feeling more pain maybe due to the fact of your disappointment of the settlement they offered you, since you state was a very low amount. You probably thought after you got a lawyer and based on prior statements of other friends/family of their “big” settlements or the advertisement of TV ads, billboards or movies that you would get a lot of money, only to find out that they don’t value your injury as much as you hoped.
But even if you decide to get more medical treatment, may not be a guarantee they will offer more, since most likely this claim is at least 3 months old or more and could put suspicion on any other treatment you received.
Tell your lawyer to hold off since he will get 1/3 of this settlement. But;;;;;it is possible nothing may change and 6 months from now, the settlement they offered most likely will remain the same.
good luck
Don’t sign anything without legal council! You may be (and probably are) entitled to MUCH more than the insurance company is offering. However, in answer to your question, whatever you sign will override your verbal agreement.
