workers comp settlement?

Fractured my ankle on 7/30. My doctor is finally letting me go back to work on 9/21. Workers comp started sending me payments for being out of work. My question is: I will have a WC hearing in a few months, will they give me a settlement just for fracturing my ankle? Do they give you settlements because you were injured on the job. I am not familiar with WC and I get conflicting info from the WC board .

  1. With workers comp, you do NOT get pain & suffering.

    Settlement means, they don’t pay any more claim, in exchange for paying you up front.

    So if you’re going to have ongoing medical expenses, they might settle for that up front. But if you’re looking for pain & suffering, you don’t get it.

    And being back to work, there aren’t going to be any lost wages settlements, either.

  2. why do you have a hearing?? Was there a problem with your claim?? Did you request a hearing?? You MAY get a settlement, however don’t plan on retiring on it.

    Well why did you have a hearing for this claim? What is the current status of the claim. Was this claim denied? Was this claim accepted? There’s no way to comment on settlement w/o details of the claim. The only reason I see a hearing is for a denial of a claim, you don’t agree with the PPD/PPI % the doctor gave you or you filed a hearing for the fun of it, yes people do this.

    What do you expect to get out of this? If your claim is accepted you’ll get your PPD/PPI award but there is nothing to settle.

    If your claim is denied than your settlement could be a small amount such as $2500 to go away.
