workers comp settlement what to expect for ca?

how much money can i expect to receive
I have been off work for 4 yrs, the ins co, has been very decent to me, however I dont think i will ever do the proff type of work i did prior to my shoulder injury, now my other shoulder has gone bad and im really wondering what they will do as far as a settlement, my injury was in 2002 and im in ca. I have had 3 surgeries , and still being treated. Im just scared as to what to expect from workers comp? Any advice? I do not have a lawyer I never felt that I needed one since the ins co again has been good to me.

  1. You don’t get ANYTHING for pain and suffering, for workers comp.

    You can expect to get lost wages for your time you were disabled, and medical payments.

    We’d have NO idea what they are.

  2. Well what was the injury? Are you still at work? Are you even working? What is the current status of your claim? What makes you think you’ll get a settlement?

  3. You do NOT get lost wages… you receive wage replacement benefits
    while you treat/recover from your injury. There are no lost wage
    payments in WC. There are NO ‘medical payments’ in WC. once you are
    determined to have reached a stable condtion, MMI, you’ll be rated
    for PD/WPI… depending on the facts surrounding your claim…that
    you have not presented here. So there is no way to tell what the
    potential value of the indemnity in for your injury. Calif, as in
    most states, has predetermine a set number of weeks indemnity to be
    paid based on your final rating. Unless you are rated 100% PD,
    those weekly benefits will eventually come to an end. You are not
    compensated for the inability to return to your pre injury job, or
    employer. Indemnity is paid based on your reduced capacity to
    compete in the open labor market. No lost wages, no pain and
    suffering, no punitive damages. WC is no fault. Benefits are
    limited, and eventually end.
