  1. The CA Department of Industrial Relations (DIR) website has info on this.

  2. That mandatory settlement hearing, means you HAVE to go before a judge, to settle the claim for future lost wages and medical costs.

YOUR ATTORNEY will explain exactly what happens. If the claim SETTLES, then that means the money gets paid out, once and for all.

  3. Not true mbrcatz, not in Calif. MSC/conference is a hearing
requested by your atty, or the defense atty, it means you have
reached MMI, been rated and a conference is to held to determine IF
there can be a resolution/settlement to your claim. EIther by
stipulations where the indemnity payments continue and medical
stays open, or a C&R where the claim is fully closed, including
medical. This happens if possilbe, if not, then a determination of
discovery is complete, if so, then a trial would be set. If not,
you’ll be seen be another Dr for additional reports. The above is
only IF these issues are the reason for the MSC… depends on the
reason for the hearing. Could be for a disputed medical issue that
requires a judges decision regarding provision of benefits. YOU
will not be seeing the judge that day. You’ll be in the waiting
room with all the other IW’s who have attorneys. IW’s only see the
judge at hearing if they don’t have atty, or when there is a trial.
You DO NOT have to settle this claim at the MSC. If you are not
comfortable with the offers you’ll be presented with…don’t sign.
