JUST OPINIONS ..IF INSURANCE DENIES MY CLAIM AND THE STATE IS TAKING CARE OF ME FOR NOW ..LETS SAY THAT THE TOTAL IN CHECKS IS 9000.00 WHO PAYS THE STATE BACK ME OR INSURANCE WHEN I GET MY SETTLEMENT . THE STATE KNOWS THAT INSURANCE DOESNT WANT TO TAKE MY CLAIM .
BROKE ANKLE AT WORK ,I REPORTE THE NEXT DAY . THERE ON DOCTOR MADE REPORT SAYING THAT MY INJURY .IS CONSITED WITH MY INJURY.BUT THEY STILL DENIED ,MY CLAIM BASE ON THERE FINDINGS WHAT FINDINGS ,WERE THEY WERE NOT THERE WHEN I GOT INJURED.

  2. The money you get from the insurance will have tp be paid by you back to the state.

    Typing in all caps is rude and a sign of immaturity.

  3. You have to get an attorney and do a workmen’s comp claim. Should you win, your attorney gets the check, takes his fees out, sends the balance to you. You then are responsible to pay the state back because if it weren’t for the workmen’s comp injury, they would not be paying you and they want their money back.

    I am at that point now.

  4. State please… WHAT STATE are you in…. If you are paid SDI/state
    disability, and though the comp process are awarded temp wage
    loss/TTD, the IC will reimburse the state for the time you received
    SDI. You cannot be paid SDI and TTD for the same periods. That
    would be double dipping. The state is not reimbursed through
    reduction of your WC award/settlement. And, the atty does not
    normally receive the full check, the IC pays the atty fees based on
    the judges award/approval of the attys request for fees. There is a
    lot of misunderstanding of WC and how the system works. Its much
    different that a civil/tort case. Much of the misinformation begins
    on message boards. Like you are reading in these posts.
