Workers comp for 5% impairment to my knee.?

I was attacked at work while recovering from surgery in my knee.. I was under restrictions which werent follwed, and had to have another surg on the same knee I had done 4months before. I was still under Drs care and my knee was doing great. I had to have surgery again after being attacked, and there was torn cartiledge, my ACL(which was replaced in the first surgery) was torn length wise. I had bone on bone due to the cartiledge being ripped out, and now will always have bone on bone, which could pose mpre probs down the road. Work comp called and offered a settlement of $1700.00. I dont know what to do. I know if I have to have surgery again this will not pay. Also I am in Ks incase any of you know how the law is here. Thaks for any advise and help

  1. It depends what state your worker’s comp case is in and the date of the injury.

    California, 5% impairment is equivalent to $3450.00 post 2005 injury years. Of course this PD percentage and value may be increased after adjusting for age and occupation.

    What kind of surgery do you need in the future? If it is a Total Knee Replacement, then I would not take the carrier’s offer. If it is anything else, $17,000 settlement is reasonable. ( I assume the $1700 in your above text was a mis-type. If not, this figure is way too low).
