Workers Comp doc is returning me back to work on light duty, still in pain?

I was injured on the job couple of months ago. I had an x-ray which shows I have a sprain or strain of the cervical spin, degeneration of cervical intervertebral disc. I have difficulty sleeping at night, and I am in a lot of pain. I’m taking Sulindac, Hydrocodone/acetaminophen and Robaxin that does not help with the pain, only makes me sick and drowsy. Workers Comp was denied, although I had a QME appointment, that could over turn that decision. Meanwhile my occupational physician is ordering me back to work on light duty for 4 hours a day with only the restrictions of not to extend/flex neck, not to reach above both shoulders or to lift/carry up to 10 pounds. I returned to work in a lot of pain, unable to complete work shift and I’m unable to take medications while working or driving. Went back to doctor for help only gave me stronger meds and sent me back to work! my employer will not accept a note from my regular doc, because its workers comp. What do I do?

  1. Well, if you want to get better and off the meds. then read these articles by Dr. Bookspan.
You may be surprised that your posture is probably the problem, but you can change it and start getting better. I have changed my posture and am getting much better.
It doesn’t hurt when you do these things and they are free. If it doesn’t get better then email her. email me if I can help more.

  2. At this point what you need is an attorney.

  3. You jumped from your PTP/compDr, to your own personal Dr…the
ER/IC does not have to accept your own Dr opinion here…only the
PTP controls your benefits, and/or work restrictions. Go back to
the comp Dr, and get your restrictions changed, lifted, or returned
to a TTD status because your ER can’t accommodate the light duty
restrictions. You have to treat with a Dr in the ER/IC’s
MPN/Medical Provider Network. Trying to go outside the comp rules
can and will affect your benefits. Your ER/IC controls the medical
    in your injury/claim…not you.
