I took a workers comp settlement and I was also on S.S.D. at the time of the settlement they made me put money into a saving acct. for my workers comp. injury doctor visits, ……what if I was to spend that money on other things ? what would happen ? would I lose my medicare and other ins. from ssd ?

  1. I would consult your work comp attorney on that one.

  2. Yeah, I would consult someone “official” on that.

As a tax payor who is not opposed to people injured during work getting workers comp – but AM OPPOSED to people who milk the system and can go back to work – I am glad that oversight into w/c claims is stricter now.

They do look for liars & have them PAY BACK money …. so be very careful how you use money granted to you for survivial – don’t abuse the system.

  3. You have a mandatory WCMSA/WC Medicare Setaside Arrangement. You
should use those funds only for services/treatment Medicare would
normally be responsible for. You also know you must provide a
statement, self attestation, to CMS/Medicare every year on what
money you have spent, and for what purpose. While there is no law
that says you cannot use the money as you wish…You must also
prove you have exhausted all of the MSA money, including reasonable
interest, before Medicare will pay for treatment to your work
injury. So, while the laws don’t say you can’t… it’s not a good
idea. And, Metella…get over yourself..you are not the SSA police.
You are very fortunate that you appearantly don’t need the benefits
Social Security provides… don’t deny them to those who do. You
    know nothing about this poster.
