worker comp settlement?

worker comp settlement. how much i am going to get. i get $1100 ever two week from comp. i doc gave me a 72% as a whole MMI. i have a 3level spine fusion. what going to be my pay out in chicago WC. plz help me with this before i going to court

  2. Wow, that’s a lot permanent partial disability/impairment (PPD/PPI) for a back injury even with three fusions. If 72% is what you got you can expect to get about $50,000-$100,000 for that injury. However each state is different so the rates might be different. Again it’s for 72%.

    As for settlement of the file, it really depends on what you want to do with your claim. Do you qualify for vocational rehab (VR)? Will you be on ongoing medicals for the rest of your life? Are you able to return back to work?

    Lots of questions that you need to provide. If you don’t want to go back to school and close out your medicals you can get probably another $50,000 to close the entire file out. If your willing to pay medicals by yourself. If you want to keep medicals open for your back than your offer would go down so it could be $25,000 instead of the higher amount.

    You can always make the first offer, such as $100,000 plus your PPD/PPI. But if you want to keep meds open, than you will have to lower your rate to maybe $80,000 + PPD/PPI.

  3. Not a good idea for numbers/dollar amounts to be provided for Il
    comp settlements. In Il, settlements are not based on PPD ratings,
    but rather negotiations and what prior claims with similar injuries
    have settled for. Case law comes to mind, as reference in
    settlements. Therefore, there is no way to tell what this claim
    will finally resolve for. There are too many variables to take into
    consideration. Especially on a message board.
