What would a Workman’s comp case with a total knee replacement involved, be worth? Anyone know? Thanks?
I had an on the job injury, 3 surgeries, the last requiring a total knee replacement, I live in oklahoma and was wondering if anyone could tell me what a settlement like this would be worth. I can not return to my chosen career because of this and I made good money. I have been struggling to make ends meet ever since, and I do not want to settle for nothing, please make any suggestion in a dollar amount that would be worth this injury. Thanks

I’m sure each state’s rules are different, but similar enough. You’re going to find that the settlement isn’t much, I’m afraid. Usually what they try to do if you can’t go back to work doing what you did is to re-train you. However, if you EVER had any other kind of job, in your entire life, they won’t. They’ll make you go back to that line of work. Even if it doesn’t pay as well. The L&I system really sucks. I broke my ankle a few years back and it turned into a real nightmare. I eventually did get to go back to work, but I don’t have full use of that ankle/foot any more. It was in a cast for too long and it locks up all the time. Not to mention I tend to twist it over all the time because it’s not as strong as it used to be. There was NO settlement.

you have reached MMI/Max Medical Improvement, your condition will
be evaluated and a PD rating issues. Indemnity benefits are
predetermined by scheduled loss award, or whole body impairment
award. A number of weeks continuing benefits will be paid based on
that PD rating. So your TKR is not worth a dime.
