what is the highst settlement dollar amount to a worker with sholder injurys paid by workmans comp in missouri
if a person is cosidered 100% disabeled because of an injurey to both shoulders and has a secondary injury to both shoulders because was made to do work after the first injurey doing other than light duty causing sever tearing of rotter cuffs in both shoulders making it impossible to fix, what kind of settlement could be expected?

Well, I imagine that the injured is currently undergoing some kind of medical treatment. If so, continue the medicl treatment as long as needed– I would say that the proper settlement should be atleast double the medical bills. Most importantly if this position has caused 100% disability, working there should stop if at all possible, if anything should be a a light duty status.
One, there is no maximum settlement, indemnity is based on residual
impairment once you have completed treatment, and been rated for
partial/permenant disability. The WC laws are state specific. In
most states, IF you are declared 100% “disabled” under the comp
definition, you would continue to receive the weekly benefits as a
life pension. You cannot force a lump sum buy out of the claim.
Two… any restrictions you have due to your injury are on YOU, not
your employer. You are charged with only performing those tasks you
know to be within those restrictions. Not your employer… Three…
If you are 100% disabled due to your work injury, you should NOT be
returning to the same job and/or job duties. So, I doubt you are
are 100% “disabled”… Three… indemnity due to impairment is NOT
paid at twice your medical bills. WC benefits are limited, and set
by law. You cannot sue your employer for more money than the law
allows for your injury.
