What is an estimated payout for worker comp case on a fall with injuries in IL ?
I was wonder about an estimated value of a settlement on a worker compensation case. I was at work, and fell down some stairs. The injuries sustained were bruises to both elbows, a cut on my left elbow requiring 3 stitches to close it. A torn bursa sack in my left elbow. I also received right shoulder strain. I was off work for almost 2 months with no pay. Those are the facts. I still work at the plant for the same company. The company is a utility company for electricity. I was wondering about how much money I can possibly receive from this?

Well there are some missing information that needs to be provided.
-Why where you off two months and not paid?
-Was your claim accepted?
-Are you currently working for your company?
-Did you get laid off?
-Was there any surgery done?
-What is the current status of the claim?
Lets say your claim was accepted, you should have been paid your money while you where off two months, you should have received temporary total disability (TTD). Again this is assuming your claim has been accepted. If you claim isn’t accepted than this is maybe the reason why your not getting paid at all.
If your currently working for your company than your not qualified for vocational rehab (VR) which means that you not eligible to go to school since your working. If your doctor provided you with permanent restrictions in which your company cannot provide than you would be qualified. If you got laid off while on any type of restriction than you would qualify for TTD, if you were laid off due to company shutting down or relocating to another state or city, than your likely qualified for VR if you don’t move with the company.
You could get a small settlement if there was surgery done, but based on the information looks like just bed rest. Surgery typically pays out what is called permanent partial disability (PPD). That’s when you lose a certain percent of a body part or a whole person. Each state is different with PPD.
The status really depends on the questions provided, accepted? Denied? Still open? Based on the information that you gave me it’s unlikely that you’ll get any type of an award. If you get a PPD award I wouldn’t think it be much money at all. Your injury of a torn bursa is really bursitis, it can be painful but commonly you don’t get anything out of this.
What you need to find out really is why you didn’t get paid for your two months off of work. If it was accepted I would be looking for that money, work comp should have paid your TTD.
