In a rare case for a state that has long offered illegal immigrants sanctuary, an appellate court in Oregon has ruled in favor of a state agency that denied an illegal alien costly public services based on her immigration status.

Oregon’s largest regulatory agency, the Department of Consumer and Business Services (DCBS), rejected a claim to provide and illegal immigrant vocational assistance benefits after a 2005 work injury that resulted in a permanent impairment. The DCBS, which administers state workers’ compensation and occupational safety laws, still awarded the illegal alien an undisclosed award for the impairment.

However, the woman (Carmen Carreon) wanted more taxpayer-financed perks in the form of vocational assistance. The agency determined that she was ineligible for the benefit because she was not authorized to work in the United States. Carreon had the audacity to sue the DCBS for denying her the services, claiming that the agency’s director overreached by creating an eligibility requirement not granted by Oregon’s legislature.

The Oregon Court of Appeals disagreed, ruling this week that state law grants the agency’s director the authority to establish additional conditions for providing vocational assistance. Imposing a rule that requires a person to be legally authorized to work in the United States is a valid exercise of the authority granted to the director, the court said in its decision.

Public agencies seldom reject illegal immigrants in Oregon, which has a statewide sanctuary law prohibiting police agencies and local governments from using any resources to apprehend or report illegal aliens. The state’s largest city-Portland-has its own official sanctuary ordinance aside from the blanket measure.

These sorts of protections have evidently emboldened illegal immigrants who are increasingly taking legal action against government agencies for denying their “rights.” In the last few months alone, illegal aliens across the nation have sued various law enforcement agencies for violating their constitutional rights. Among them is an Ohio sheriff who helped deport a Mexican with false identification cards, a Maryland sheriff who arrested an illegal Salvadoran woman and federal agents who apprehended a group of illegal aliens in a Connecticut immigration raid.

  3. Sanctuary cities should be denied all federal aid and troops should be sent in to enforce our laws just as they did in Alabama with Governor Wallace when he defied federal law.

  6. The Constitution was intended to protect the rights of American citizens, not illegal aliens. What are people like Ms. Carreon going to try next — sue a state for denying them their constitutional “right” to vote?

    Suits like the one Ms. Carreon filed should be dismissed as frivolous and the plaintiffs should be ordered to pay all court costs.

    I am surprised but delighted that an appelate court in very liberal Oregon ruled as it did. How can someone who is not a legal resident of the United States claim to have constitutional rights under the Constitution of the United States? What if Ms. Correon return to her home country and was arrested. Would she call the U.S. Embassy for assistance?

  7. if they are not legal they have no constitutional rights. the agency was in it’s rights to deny her. if she was not here illegally working she would not have got hurt in the first place. i hurt my back 2 years ago. there is a pinched nerve going across my spin on my lower back. and yet i still work and have sued no one for this. illegals are just coming here to get what they want and it’s at our expense. very sickening. and sad on their part.

  8. The situation is already bad enough as it is. At least twelve million illegal immigrants are in this country and eight million illegal aliens are in the American workforce. Additionally, our government issues 75,000 permanent work visas and 50,000 temporary work permits to foreign workers every single month. A recent census study found that one out of every six workers in this country is foreign born.
    “Comprehensive Immigration Reform” and “Path for legalization” are nothing but code words for amnesty. The last two times the open borders folks introduced amnesties, they at least established some preconditions and made illegal aliens jump through a few hoops and before they could get amnesty. Under Gutierrez’s bill, every single illegal alien in this country the day of the bill is signed will be eligible. This gives foreigners a great incentive to come to this country illegally because they know they’d soon be eligible for amnesty. A recent Zogby found that 56% of Mexicans said themselves or people they knew would be more likely to enter America illegally if they knew an amnesty was coming.

  9. So this ‘poor’ injured worker wants vocational rehabilitation
    assistance to find yet another employer to offer work…illegally,
    as she had found to begin with… of course, why not… just like
    other countries offer US citizens who have choosen to live
    ”illegally” in thier countries… When the United States gets rid
    of the tree huggers that comprise the special interest groups
    currently running this country… the first benefit will obviously
    be a reduction in income taxes. Well, as soon as we pay China back
    for the money we borrowed to pay for all these entitlements to
    begin with. What it is now… a 12 TRILLION PLUS national debt…
    or it is SEVENTEEN… ? Doesn’t matter… it’s over 67 MILES high
    when stacked up. Sorry…off topic here.
