if i get a settlement from workers comp what amount would be considered fair and unfair?

  1. It totally depends on the situation of the claim. Will you be able to return to usual and customary duties is one question. Do you have any pre-existing injuries to the same knee?

    What you will get is a permanent partial disability/impairment (PPD/PPI). There’s not telling how much you will get as it depends on the rate your doctor gives you. So the award could range anywhere from $1700-$10,000.

    A torn ACL typically doesn’t yield much settlement value other than PPD/PPI value. If you are unable to return back to your usual and customary duties than you could qualify for vocational rehab. That would be going back to school and learning a new thing for 2 years. However that depends on how much you get paid, you restrictions and such. If you don’t want to go to school you can always settle this portion out.

  3. There is NO guarantee of a cash settlement in a comp claim.
    Indemnity benefits are paid based on your PPD rating at the time you are declared MMI and released to return to work.
    Next time…post your STATE, WC is STATE SPECIFIC.
