Walmart employee injury?
I’m asking this question for my mom. Shes has worked for walmart 2.5-3 years and recently got hurt in her dept. Shes is a manager and has busted her ass to get there. A metal rack fell on her which was broke and everybody knew it including the managers and they did nothing. She went to the hospital the next day at St Francis and she has a chip in her shoulder as well suffered a concussion. The next day after that she got a call from the managers saying she needed to take a drug test and see “Walmart doctors”. She was also told this is common knowledge and she will be written up for not following protocol even though her manager on duty just sent her home early. So she passed the drug test and seen doctors at the drug testing facility which said the same thing St Francis said. She offered her insurance card at both places and they refused saying they were filing it under workmans comp. Well 2 days later which would be today this happened,She went into work like she normally does and was treated bad. She said they wouldn’t talk to her (The managers not reg employees) and that today at 5 PM she would need to see there doctors once again. She explained to them she take the bus and could get there but not get back. They told her that if she did not see them they would put it under “Indefinite personal leave” until she sees them. She’s worried she’s gonna get fired tomorrow and that they can fight her unemployment if she is fired and doesn’t wanna call the home office because of retaliation. My question is if she gets fired for this can they fight her unemployment and can she sue? Thanks!

Did she file a workers comp report? If she didn’t she needs to file that immediately. The store should have the paperwork she needs.
Has your mom filed the workers comp paperwork? It sounds like the doctors are ready to submit the paperwork. With worker’s comp, all the medical bills will be provided by the workers comp insurance, not your mom’s insurance.
If your mom did something wrong with the cart making it fall, she could be written up. This will not impact the worker’s comp process and if nothing else happens should not impact future work with Walmart.
Walmart also wont fire her for having this accident.
If possible you should arrange for someone to take her to the doctor and back to work this afternoon so that she doesn’t miss too much work.
