unemploy/ workers comp.. question please respond.?
Ok, I was injured on a job Sept 5th 2007, and there has been no response back from workers comp, so I got a lawyer to back me up in claiming, but before I got the lawyer I had filed for unemploy, I told them about my acciddent back in October. They had denied me at first but after months, they sent me 2 checks for the my past claims back in October. Now if I cash those two checks will it some how effect my workers comp claim? Or will it be fine? answers greatly appreciated.

YOu better ask your atty. USually a disability claim kills an unemployment claim as you must be physically able to take a job; and if you cash that check, you may be saying you aren’t actually disabled.
Ask your lawyer. How do you even qualify for unemployment is you are on workers’ comp? Were you fired or did you quit? That might be the issue. If you are in effect still showing as a active employee, then wrokers’ comp will probably be void and null for the time period that those checks cover. And if you are still active, and you have received unemployment checks, then you have the state to payback. You cannot receive ‘double-pay’ is what it comes down to.
this is why you have a lawyer but why are you getting unemployment when you were injured really let the lawyer know of that or you will or could be in hot waters.
WHY did you file for UI if you knew you are injured and could not
work? If you ‘lied’ and said you could work if offered suitable
employment, and you knew you couldn’t … you committed a fraud
against the state you live in. Take the checks BACK to the UI
office and beg their forgiveness and claim stupidity… that’s
going to be your best bet here… or get ready to pay a potentially
significant fine.
