settling a workers comp claim , my doctor says that i am 77.5% disabled in left shoulder and elbow combined.?

their doctor still hasn’t put a rating on it , and hes had two chances to do so. can i ask for a settlement based on my doctors opinion.

    Yeah you can! They should definitely put you on workers comp after your doctor says something.

  2. “?” … did ya read the post…? Your question is not supported
    with enough information to tell what the situation is. Once you are
    MMI, and rated for disability/impairment, the Dr report goes to the
    Claims Adjuster/CA. If there is no dispute to the rating by your
    Dr, the claim will move toward resolution/settlement. If there is
    dispute by the CA…you’ll go to one of their Dr’s for evaluation.
    Settlement can be reached at any time the parties can come to an
    agreement. With a rating of 77%, you should expect a dispute.
    Possibly a hearing in comp court for a judge to decide on your
    case. If you’d provide your STATE, it would be easier to help
    explain what benefits you may be eligible for. Also, with a
    impairment that high, you should think VERY carefully about closing
    the medical in your claim. Once you do, you will be paying out of
    your pocket for any and all future medical treatment to your
    injury. You cannot force a lump sum payment to close this claim,
    and if it’s not in the carriers best interest, it’s not likely to
    happen.
