QUESTION FOR LAWYER WORKERS COMPENSATION?

I was working in a heavy job, when all of a sudden i felt pain in my back , i reported to my supervisor two weeks after. my accident was in july 25 2008. But i was still working until september 25 , 2008. on september 25 i stoped working. until the moment i haved received a workers compansation for one year & on may 19 2010 i went to court in front of the judge i lost my case because my supervisor sayed i never told him about my accident .the first doctor i saw , said that i never told him about my acciedent.but in reality i did tell them about my accident . my doctor is saying that i need surgery. but the judge denied all my benefits ,becuase he said i didnt report the accident in 45 days .my lawyer he doesnt want to appeal my case but i want to appeal my case beacuase i did report my case to my supervisor two weeks later maybe the doctor didnt understand me because of my english is very bad but i told my doctor about my accident now am looking for a new lawyer that would like to take my case and appeal.

  1. Unless you tell the supervisor right away when you are hurt at work, there is no way for the employer or their insurance company to know when or where you were hurt. The law may say 45 days, but if you don’t report it *immediately*, you don’t have much chance of winning a claim. And no chance of winning an appeal. Sorry.
