Pa workers comp question?

Monday, January 30, 2012
By WcrAdmin

Hello ya’ll. I was hurt on the job. I was trying to be a tough guy and fight through it.On my own, I went to the doctor twice to see if it will get better. My back got worse and worse. So i finally, told my boss three weeks later. He said i can’t go to workers comp because i didnt tell him right away. I just found out he lied to me and a lawyer said she can help me. What are the procedures of workers comp? Is it a settlement by insurance company if i’m still in pain and they say i should be ok, do i have any rights?

One Response to “Pa workers comp question?”

  1. Hello there. Your boss is lying to you my friend. He just doesn’t want you out on workers’ comp. You have 90 days to report a claim and even if you miss that amount of time, no one will prevent you from going on comp. The procedures for your case should be as follows:

Contact a workers’ comp attorney. Explain to him/her the situation. After this, you’re attorney will probably get you out on workers’ comp. When you are finished treating (it may take quite some time if you have a back injury), you should file a claim petition. Then your company’s attorney and your attorney will negotiate and a settlement will transpire.

As the injured worker (especially in PA), YOU HAVE ALL THE RIGHTS! Don’t let your employer push you around. Take care and good luck!
