My employer laid me off a year ago and I filed for unemployment benefits and received them and now?

all of a sudden he is saying after one year that he fired me when he laid off 4 guys the same day he laid me off. He receives reports of benefits collected from his laid off employees on a periodic basis so he knows I’ve been collecting.

So my question is – why after one year of it being ok for me to collect benefits, does he all of a sudden say he fired me when that wasn’t the truth? He is denying further claims on my behalf.

This is a person who did not report an on the job injury to workers comp until forced to, asked his employees to bank hours instead of paying overtime, and made them work in unsafe conditions at times.

What recourse do I have now? I think he is committing fraud by making intentional false statements.

  1. has he called unemployment and told them this?

    if he did, you are going to be met with some nasty letters from the state asking for all the money to be returned.

    you need to contact unemployment and first ask if he has filed a complaint and if yes, then you need to seek the aid of an arbitrator; file a grievance and then wait for your day in court .

    if not, then i would not worry about it.

    on second thought, i would wait to see if unemployment contacts you for repayment…..perhaps remaining silent is the best way not to open a can of worms.

  2. Appeal it. By the way, when he laid you off, didn’t he have to give you some sort of separation certificate that said why you were leaving your job? If it says you were laid off, he is going to have a hard time proving that you were fired. Check out that certificate and see what it said. Good luck!

  3. The only issue that affects you here is YOUR unemployment. Forget
    about all the other things you are ranting about. They have no
    bearing on your situation. No one on a message board can tell you
    why your former employer is doing or saying the things he is. Go to
    the source and ask. Or, just deal with the issues as they arise…
    anticipating problems will always guarantee you will have them.

  8. Unemployed people don’t need a handout from the gov’t (ie, the
    taxpayer) for a few more months – they need employment and a salary
    they can depend on. All this does is secure more votes from the
    indentured class.
