CA Court Says Undocumented Workers Can Get Workers’ Comp
A California court has ruled that undocumented workers in the state are entitled to workers’ compensation benefits when they are injured on the job.

Because of confusion about the rights of undocumented workers employed in California resulting from a recent U.S. Supreme Court decision, the Department of Industrial Relations is providing the following clarification of its enforcement practices:

All California workers are entitled to workplace protection

Q. Are undocumented workers protected by California labor laws?

A. Yes. All California workers — whether or not they are legally authorized to work in the United States — are protected by state laws regulating wages and working conditions. All California workers have the right:

To receive a minimum wage of $8.00 per hour
To earn overtime pay — with some exceptions — after working more than eight hours per day or more than 40 hours in one week
To file wage claims with the state labor commissioner if they believe their employer has violated state wage laws
To file workplace safety and health complaints with Cal/OSHA, the state’s workplace safety and health program
To work in an environment free from retaliation for exercising their rights

Some California employees qualify for overtime pay. The Fair Labor Standards Act requires your employer to pay one-and-a-half times your regular hourly pay rate to you if you are a non-exempt employee and work in excess of 40 in any workweek. Illegal Immigration Costs California Over Ten Billion Annually
State’s “cheap labor” costs average household $1,183 a year

In hosting America’s largest population of illegal immigrants, California bears a huge cost to provide basic human services for this fast growing, low-income segment of its population. A new study from the Federation for American Immigration Reform (FAIR) examines the costs of education, health care and incarceration of illegal aliens, and concludes that the costs to Californians is $10.5 billion per year.

Among the key finding of the report are that the state’s already struggling K-12 education system spends approximately $7.7 billion a year to school the children of illegal aliens who now constitute 15 percent of the student body. Another $1.4 billion of the taxpayers’ money goes toward providing health care to illegal aliens and their families, the same amount that is spent incarcerating illegal aliens criminals

  3. It would be a plus if they would annex California into Mexico and build a wall around it, for the elected officials to promote illegal immigration is a crime and they should be prosecuted for it.

    A. No official or agency of this state or a county, city, town or other political subdivision of this state may limit or restrict the enforcement of federal immigration laws to less than the full extent permitted by federal law.

    B. For any lawful contact stop, detention or arrest made by a law enforcement official or a law enforcement agency of this state or a law enforcement official or a law enforcement agency of a county, city, town or other political subdivision of this state in the enforcement of any other law or ordinance of a county, city or town or this state where reasonable suspicion exists that the person is an alien who and is unlawfully present in the United States, a reasonable attempt shall be made, when practicable, to determine the immigration status of the person, except if the determination may hinder or obstruct an investigation. Any person who is arrested shall have the person’s immigration status determined before the person is released. The person’s immigration status shall be verified with the federal government pursuant to 8 United States code section 1373(c). A law enforcement official or agency of this state or a county, city, town or other political subdivision of this state may not solely consider race, color or national origin in implementing the requirements of this subsection except to the extent permitted by the United States or Arizona Constitution. A person is presumed to not be an alien who is unlawfully present in the United States if the person provides to the law enforcement officer or agency any of the following:

    1. A valid Arizona driver license.

    2. A valid Arizona nonoperating identification license.

    3. A valid tribal enrollment card or other form of tribal identification.

    4. If the entity requires proof of legal presence in the United States before issuance, any valid United States federal, state or local government issued identification.

Yeah while we’re at it lets kick out Arizona for being racist, Alabama for promoting incest, New York for being a terrorist attraction, Louisiana and Florida because of expensive hurricane damage, Texas for trying to be too independent…. and so forth… tossing states is a sh*tty idea lol, but if all you’re concerned about is making money then legalize marijuana, plenty of studies have shown that it would reverse California’s deficit within a few years.

  5. All that needs to be done is to cut off all federal aid to California. By harboring illegals, California is in violation of Federal law. Seems that a cut-off of Federal funds is in order.
