im on disability i was declared permit partial disabled PPD in 2000 in new york state, i collect social security and also workers compensation . my question is once im declared disable by the courts do i still need to treat with my doctors, i have moved out of new york and my doctors really couldnt do anything for me for my condition.

  1. If you are permanently partially disabled and there is no treatment and you have no other source of income – than you are probably OK. If you are working- you will need a doctor to say you can’t work more than you do about once every 3 years when they do their tri-annual re-evaluations.

  2. Every few years Social Security disability has you requalify and they ask for all your current Dr.’s and then they check with them to determine if you are still disabled. I have a chronic illness but still have to requalify even though the Dr.’s write than my condition only will worsen over time.

  4. The question here is about what Doctors to treat with…. HOW would
    you be able to treat with doctors in NY if you live out of state…
    unless you live just across the state line? Your WC claim, and the
    SSA/SSDI claim are totally seperate, and not related. The only time
    SSA would have any interest in your comp claim is IF you were to
    settle that claim affecting the medical coverage. Medicare
    interests must be addressed in any closure of the comp claim. The
    money you receive from WC and those benefits from SSDI cannot
    exceed 80% of your pre injury wages. Be sure to report any change
    in your physicial/financial condition to SSA as soon as possible.
