If you get hurt at work are you required to take a drug test to file a claim?

This would be in Florida if it makes a difference. A co-worker got hurt and they did not send her for a test. This is about the third time she has been hurt on the job and has filed claims before. I have been with the company for 11 years and they use to make you go for a test but when I asked the manager if she went for a drug test I was told the company doesn’t make them go. Just curious!
Job is with an Auto Parts store.
Very large company that is nationwide.

    requested to do has nothing to do with you. Unless you suffer an

  3. Not sure about that..but i do know it takes like 1 month for pot to get out of your system b/c its fat soluable. Versus Heroin that is “water soluable” and pretty much leaves your system pretty quickly.

  4. You’re never required to take a drug test unless the private company makes it a policy. I would assume that most companies would mandate testing for suspicious circumstances surrounding an injury, but no government agency will make you take a drug test after you get hurt.

    Well, actually, I just got hurt at work, a 90 pound box of tile fell on my toe, shattering it, I did have to go for a drug test, so I will say it probably depends on the state and the employer, and if she refused to take the test if required, then i don’t think the company has to pay workers comp or anything like that, but it would probably be best to look at what laws are in your county, state and check the company policy.

  7. It just depends on the company. They probably don’t give a rat’s pa’toot if people are on drugs. In my experience, the companies around here ALWAYS do drug test. But I would say the company is too cheap to pay the tab. Drug testing is outlandishly priced today. They’d propably prefer to pay the Comp.

  8. Usually any company immediately requires a drug test to see if they are liable for the accident or not. If the company doesn’t require it they are stupid. They are putting their a** way out there on the line. The first thing that railroads or warehouse companies do or any jobs using power tools is make sure that the person hurt wasn’t under the influence. If they are under the influence then the company’s workers comp doesn’t have to pay the damages. The worker is responsible and is subject to being fired.

  9. it all depends what state you’re in and what company u work for, MOST workers comp. insurance company’s require u to take a drug test for them to pay for the medical bills, also your employer can do random drug testing when ever it feels like it :) i know Lowe’s home improvement does for a fact, most small business, mom and pop joints don’t because it’s so costly.

  10. It really depends. Some companies insurance companies or the state Workman’s Comp will require that they be given a drug test because if they pop on the test then they are not liable and can make the person liable as well as let them go. Some companies do not do it because of the costs related to the tests. They are not cheap and they “trust” their employees, are not required to do it, or do not want to lose “good” help. Personally if I were running a business I would do it…. it only makes sense, seems like good business, might save my company tons of money as well as is a write off as a business expense…

    But that is just my opinion..

  11. You are required to comply with a medical examination from a provider of the employer’s choice. I would assume that includes a drug test.

    Most auto parts stores also require anyone who delivers parts to be subject to regular drug testing.

  13. yes some comps do just like when u get in car wreck if u hit someone u will be ordered to take drug test that way ur auto insurance comp can determine whom fault it could be and also some companies will have u take a drug and alcohol test i know cuz my sister had fall in her work place and some boxes fell on her she was order to take alcohol and drug test..
