If pay my long term disability uptake myself and win a workers comp case is LTD entitled to any of my $?

The company bought the policy, I paid out of my paycheck for the uptake. I have been on LTD for 2 years. I am pursuing a Workers Comp case. If I win the WC case, will the LTD be entitled to a portion of my settlement? Can I receive both WC and LTD? Can LTD lower my monthly check?

  2. Yes, the lost wages part can be attached to pay back what they paid out. LTD is ALWAYS entitled to reimbursement from other income sources.

  3. STD/LTD is not entitled to reimbursement of benefits paid, but they
    could be entitled to subrogation where there is overlap, and/or
    offset due to your receivng other benefits. As a rule, these
    policies don’t cover industrial injury/illness UNLESS there is
    language in the policy saying they do. All STD/LTD polices are
    subject to the limitations of the policy. It doesn’t matter who
    pays the premiums to answer your question here… but it does
    matter who pays to determine if your benefits from the STD/LTD
    coverage are taxable. Sounds like you are facing the difficultes
    you are asking about, and seeking verification…(?). You cannot
    get those answers on a message board… YOU have the policy, we
    don’t.
