If you are the plaintiff, and your attorney agrees with the adjusters evaluation of the claim, you can still advice your lawyer that you want to fight it at the courthouse… Remember, your attorney works for you… But also remember, your attorney has experience. If he is a good lawyer, you should take what he says under advisement. But if he is lazy, and you know it… fire him, and hire a lawyer who you think will get you what you nedd.
It DEPENDS ON:
WHICH SIDE the lawyer represents
IF the lawyer works for the insurance company, OR a third party (if a third party is involved) – then the case still goes to court.
IF the lawyer represents you, the case may still go to court IF YOU agree to the terms. BE SURE that you understand all the terms of the settlement. IF you do not understand all the terms of the settlement, be sure to ask your lawyer to explain everything. If you still do not understand – persist until you fully understand BEFORE you go to court, or BEFORE you settle.
