If I have a doctor’s excuse for work…?

can they force me to go in to work or fire me? I called in earlier with a doctors note stating I could miss one day of work for rest due to an injury and they are trying to tell me that if I can’t do my assigned job I still have to go to work and do someone else’s job that only requires me to sit.

also, they gave me 2 people that could cover my shift and neither would work for me. so I called them back and told them and they told me I would still have to come in to work. I told them there was no way I was coming in whether to do my job or anyone else’s job.

They keep calling me trying to convince me that I must come in to work or I can get fired for not going at all.

I figure this is not legal and think I may need to ring up my lawyer if they want to do something about it like suspend or fire me. what is your take?
well, i work at a pizza place, im kind of young and we don’t have unions. i never signed anything that said i couldn’t use a doctors note either. they are just stupid where i work.

  1. Depending on the state, and any possible forms you may have signed when you were hired, you may have no protection here. An employer can fire you for any reason, at their discretion. As you can also quit at any time for any reason at your discretion.

    YEAH THEY ARE BEING DUMB they are acting like it is a big corporation or something.
    They may think you are lying since it is a pizza place so i would fax the note in to them. do not go in person bc then they will say you showed up here so you can work. SO fax it in.

  3. Fax them your doctor’s note if you can not take it in yourself…whoever is saying that you still have to go in, inform them that you are uncapable of performing the job you were hired to do.

  4. Key thing here you do not mention is if whether your injury was at work or non work hours. At work injury then it would be a worker’s comp claim even if it is only 1 day you are out. This may also fall under the Family Medical Leave Act where you would be entitled to leave for up to 12 weeks (can be taken hourly, daily, etc…) depending on the type of injury, the amount of time you have been at work (minimum 1 year and worked a total of 1,250 hours), and total number of employees are 50 in the last year. Unfortunately, since it is an injury that will only allow you to be out for 1 day it would rule out a short term disability claim. However, if you have any vacation, sick, or personal days accumulated you can certainly use this time. Unfortunately, there is no legal claim here unless you would meet the Family Medical Leave Act guidelines or you have accumulated time, or you were injured on the job, OR you know of any cases where other’s have called out with a doctor’s excuse and were not forced to come in, but you have been singled out. If this were the case then it gets a bit more complicated. Unfortunately, even a doctor’s note won’t excuse you from work when you have an a**h**e for a boss.
