If I got hurt on the job and the doctor put me back to work on light duty and now wants me out of work am I el?
The doctor put me on light duty and we found out that I tore my rotator cuff in my shoulder. Now he wants to take me out of work. My job is now saying that because I went back on light duty that I am no longer eligible for workmans comp. I work in the state of Vermont. What are my rights as an employee?
They did not ever put me on workmans comp. They just put me on light duty. But the pain got worst and now they want me to try physical therapy and then surgery if needed. If the doctor decides to take me out of work due to this am I now able to get workmans comp or no. My work is saying no because I went back on light duty instead of going out on workmans comp when it first happened.
Your doctor placed you off work due to a work injury, your work comp claim continues until your doctor declares you medically stable and there is no further need for treatment. You could be off work for about 8-12 weeks if you have surgery. Your company can’t do anything about it.
