  1. There are 2 types of settlement – the first is called a Compromise & Release, in which you get a lump sum of money but release the employer and insurance carrier of subsequent liability. The number includes your permanent disability and future treatment, based on the medical records up to that point.

    The second type of settlement is called a Stipulation Award. This includes only the permanent disability, which is paid at a certain rate biweekly and the benefit is not issued all at once. Your future medical is kept open under this settlement in return. This is also based on doctor reports, outlining the impairment and treatment provisions.

  2. The amount of indemnity/settlement or award you are entitled to is
    based on a PD/permenant disability or impairment rating. The rating
    is done after you reach MMI/Max Med Improvement. Your Dr does the
    rating. If you or the IC disagree with the rating, you go to a
    AME/IME for a resolution to the dispute. If thats not satisfactory,
    you go to court. You haven’t provided enough info here to tell what
    your difficulties may be, or what the status is of your condition
    or claim.
