I was hurt at work over 1 year ago both Workman’s comp and state disability has stopped reason unknown help?
I feel as though I’ve done nothing but get worse instead of better,Depression has set in bad, at one time I was seeing 4 different doctors was put on antidepression meds. had therpy but no fail EVERY time I started to see the light at the end of the tunnel the therpy was stopped for another evail. Since I was hurt I’ve lost everything even my children, I’ve told my Attorney that has taken the time to talk to me 5 times. I had to move 8 hrs away and was told doctors would be set up for me for continued care never happened. I’ve not been released back to work, haven’t recieved any medical care for months nor have I been paid, then out of the blue I get a voice message from my Attorney telling me that after everything I’ve lost and the pain I’m still having, deep depression, can’t work that the workmans comp Ins. will settle the case for $3000.00. Have not heard from him since no return calls understand this is after his paralegal had called me 2 let me know doctors were being set up help

I don’t know what state you are in. Different states have different w/c laws. But in Texas w/c pays for 2 years before they stop paying. You need to contact your local worker’s comp commision and ask for an ombudsmen, they are like lawyers for you but they dont charge you.
It sounds like your attorney is not working hard enough for you. If you’re not satisfied with him/her, fire them and get someone that you feel will actually help. You are their client and they need to treat you as such. The depression probably won’t factor into the claim. You should contact your work comp adjuster (after you let your attorney know that you want to speak with them, most adjusters won’t talk to claimants with attorneys, unless the attorney gives permission) and ask them what is going on. Ask them if treatment is being offered or if a settlement is being offered. Make sure you have all of your medical records and can prove that the doctor hasn’t released you to work. What they have offered you may be a fair settlement, it really depends on your injury/body part. Also, it is a good idea to talk to the commission. Good luck and I hope everything goes well.
