Are you going to lose wages for it? Are you missing work for it? If the answer to these questions is no, I wouldn’t sue. You’d be setting yourself up for a dismissed case.
First things first. Did you complete a workers injury report? You can still since there was a witness. Next, get checked out by a doctor under Workman’s compensation. When you file the injury report a claim is activated under Workman’s comp, the doctor will be paid directly. Then follow what the doctor says, off work for however long, getting paid. There are guidelines you need to follow before you file a lawsuit. Any lawyer will tell you.
It does not matter if you were at fault, you were hurt at work, they need to take care of your injuries, while continuing to pay you for any lost time. But there are again procedures in place under OSHA that need to be followed.
your question is can you sue your job.. no you can not sue your employer on the Workman’s comp carrier, it is cannot to sue your employer for injuries on that’s why there is Workman’s comp
You can file a workers comp claim.
You can file for workers’ compensation. THey will pay your medical bills and after a certain number of days (depending on the state) your lost income if you are take off work.
When there is worker’s compensation, you cannot sue your employer. However, if you are an independent contractor, then you are not an employee and you can sue. But the problem then is you or your health insurance has to pay your medical bills and you don’t get paid for lost work time.
If you are in a lot of pain, you can go to a doctor or urgent care now and tell them it’s a work injury. Then tell you employer as soon as possible.
Whatever you do, don’t wait to report it, do it right away.
Id ask for compensation !
If your not off work or not loosing your wages i wouldnt sue them but i would make a complaint
