I got hurt at work and my Boss didn’t fill out an accident report. Who do I call for help?

The accident took place last year but I am now having a whole new set of symptoms. My doctors tell me I can no longer do my job. I cannot pay my bills unless I work. The nerve damage is causing me to randomly collape without warning. After this much time has passed since the accident, who can I call for help in advising me? Isn’t it against the law for an employer not to submit an accident report to the Workers Comensation?

  1. Not ONE valid response to this posters question…. Poster… if
    you notified your supervisor at the time the injury/accident took
    place, you should have been directed to access treatment to your
    claimed injury. Because you weren’t, or did not require treatment
    at that time is not reason to deny a claim now. You need to contact
    an attorney competant in WC law in your STATE. WC is STATE
    SPECIFIC, as you did not provide your state here… can’t help you
    with any SOL/Statute Of Limitations there may be As a rule, there
    is at least ONE YEAR from the date you or your Dr have reasonable
    knowledge the injury is work related to file a claim with your
    employer or their WC carrier for benefits. Contact the atty, there
    is NO FEE up front for consultation.

  3. Go find the poster with the girl with the broken arm. Write down you state workers comp hot line on it and call. All Company’s must post this phone number!!!

  4. Check with your HR department… There should be a statute of limitations… and there should be someone there that can verify the incident…. File the claim now and seek medical treatment.. I am in the same boat,…. Good luck.

  6. boy, first, if your company didn’t fill out an accident report it’s going to be a long battle for you because nothing was reported. Did you file a report to workers comp and collect? If not you may have to get a lawyer to help you out with this one. You will probably need a doctors report to prove it was work related. Will he give this to you. Good Luck!

  7. Get a lawyer, pronto. And if your accident was caused by something not being right, rather than your own carelessness (slippery floor, poorly stacked boxes that fell, chemicals that leaked out of containers, for example), call OSHA, just for grins. Employers *hate* to see OSHA show up on the property.
