How much for a workers comp settlement???

I was asked to “come up with a figure” for my workers comp claim for a settlement. I know everyones gonna say “talk to a lawyer”, but let’s not include that for this discussion. Is there a “formula” that I should go by, like my “healthy” yearly salary times x amount plus y??? How do I come up with a figure that is reasonable, Im sure whatever I ask for will be countered with a lowball offer and followed by a bunch of haggling, but what should I consider when making my initial offer?
Also, this is just the monetary settlement part, this DOES NOT INCLUDE the medical aspect of my claim.

  2. In regards to Illinois you need to go to the Illinois Workers compensation commission and look up their guidelines. Although, keep in mind that Illinois is the most generous state in regards to the employee. You could probably look up the commission in your state and find the information on their website because it is public knowledge. This is what I copied off the Illinois Workers compensation commission web site, but your state could be different. Figure your weekly salary and calculate from there
    Thumb: from 70 weeks to 76 weeks
    First, or index finger: from 40 weeks to 43 weeks
    Second, or middle finger: from 35 weeks to 38 weeks
    Third, or ring finger: from 25 weeks to 27 weeks
    Fourth, or little finger: from 20 weeks to 22 weeks
    Great toe: from 35 weeks to 38 weeks
    Each toe other than the great toe: from 12 weeks to 13 weeks
    Hand: from 190 weeks to 205 weeks
    Arm: from 235 weeks to 253 weeks
    Amputation above elbow: from 15 additional weeks to 17 additional weeks
    Amputation at shoulder joint: from 65 additional weeks to 70 additional weeks
    Foot: from 155 weeks to 167 weeks
    Leg: from 200 weeks to 215 weeks
    Amputation at leg above knee: from 25 additional weeks to 27 additional weeks
    Amputation at hip joint: from 75 additional weeks to 81 additional weeks
    Eye: from 150 weeks to 162 weeks
    Enucleation: from 10 additional weeks to 11 additional weeks
    Hearing Loss:
    One ear: from 50 weeks to 54 weeks (Workers’ Compensation Act)
    Both ears: from 200 weeks to 215 weeks
    Testicle: from 50 weeks to 54 weeks
    Both testicles: from 150 weeks to 162 weeks

  5. This situation is HIGHLY subjective…what state, what injury, etc?
    The WC insurer KNOWS asking you to give them a number is a load of
    BS WHY? That is not for you to decide no matter how you feel!
    -EVERY state has a designated SYSTEM by which they award
    settlements. After your final evaluating docs give you a total body
    impairment%, another person RATES your claim. -The RATING will
    determine your EXACT settlement amount. If you settle COMPLETELY
    (compromise and release settlement), you will ONLY receive that
    monetary settlement + any agreed medical expenses/mileage/etc for
    reimbursement. IF YOU ARE ENTITLED to future medical provisions
    (stipulation + awards settlement), you will receive future medical
    provisions (per your evaluating doctor’s orders) AND the monetary
    settlement that matches your RATING.
