  2. a very long time. My friend has been going through one for 3 years on Nov. 21st. It happened in 2005. They still haven’t settled. And DON’T take the first offer.

  3. it depends on the injury. your workers’ comp attorney may want this claim to stay open for a few yr’s for your benifit in case of long term physical problem not know now…i hope you have an attorney…

  4. It can take anywhere from 6 months to 10 years! It all depends on the injury and the severity of the claim. There are so many factors that need to be considered from both sides of the plate. It also depends if the claim is in litigation or not. If the claim is accepted than 6 months, if it;s in litigation than I would say a long time. Here are other factors:

    Vocational rehab- Are you voc elgible? Meaning do you qualify for new work education program.
    Life time medicals- Does the state allow you to full wash your medicals?
    Permanent partial disability/impairment (PPD/PPI)- Do you have any impairment involved?
    Exposure- What kind of exposure will both parties see? A possible knee replacement later in life, like 20 years?

    These are just examples of what is being considered. I always like to see how the claimant is with these kinds of situations, if you are VR eligible and don’t want to go to school than I’ll take the dollar amount and come up with a figure and add it with other factors.

    Here is some tips if you want your claim settled faster, don’t offer some stupid amount such as $1 million dollars, nobody will listen to you, even your attorney. The adjuster will offer a low amount to make you come back to earth. Come up with an offer, lets say you think your claim is work $100,000, well the adjuster will review and than counter with something low, lets say $15,000. Well, you got the ball rolling and know the lowest they’ll go. Eventually you counter, they counter and you reach an amount that satisfies both parties. Remember the insurance company is also watching out for their client, and your company will know how much you settle for.

    Don’t do anything or say anything stupid. There are some people who has been in work comp and blab about what they did while they where off work such as golfing and screwing the system, some companies offer people money if they feel that a co-workers screwed the system. Than you’ll end up in prison if you become a snobby person. Also stay true to your settlement, if you got awarded $25,000 and you found out a co-worker who had the same injury got $50,000 and you decide that you won’t sign the papers, your going to make alot of people mad, I’ve seen this alot!
