How long can i stay on Workman’s Comp?, if im on light duty.?
I work in health care and i hurt my wrist at work almost two months ago, i have been on light duty at work ever since. Just wondering how long they will continue to pay me my nurse hourly rate of $35hr if i continue light duty? I am answering phones right now and getting payed the same amount for two months now. They have done a MRI and said its something to do with the nerves. The doctor ask me what i want to do, and i tell him keep me on light duty because it still hurts bad.
How long will they put up with ”Light Duty”? They are not allowed to fire me or change my hourly pay rate as long as i am on Workman’s Comp? I live in Florida.

you are very lucky they haven’t changed your rate, here in Fl employers like to reduce your rate while on light duty, but yes they can change it
they can lower your rate or fire you while you are on WC………
whoever told you otherwise is misinformed.
it is in the employers best interest to keep you on because they can lower your wage and let WC make up the difference and if they terminate you that fact can (NOT will, but can) have an effect on the settlement…….. generally there is no real incentive (financially) to fire an employee who is on WC but it is legal to do so.
if they lower your rate or terminate you before your doctor has released you the insurance carrier will continue to pay you your WC benefits until the case is settled.
at some point in time the insurance carrier will have a FCE (functional capacity exam) done.
when this is done is based on when you reach MMI (maximum medical improvement).
your doctor will determine when you have reached MMI and are ready for the FCE.
if the doctor determines you do not have a permanent partial disability and releases you to work the FCE may not be needed.
to your question about how long they will keep you on light-duty;
that is up to the employer, as long as they see a return on their payroll dollar they will continue BUT at some point they will have to make a decision on whether or not it is cost-effective to keep you on in this capacity.
OH YES you CAN be terminated while on a medical/comp leave. YOu are
misinformed if you think otherwise. Talk to your atty about the
issues and options in your claim. Your TTD is capped at 104
weeks…after that, there is no more wage replacement benefits. How
long your employer provides the light duty accommodation is up to
them…there is no law that says they must do this. Once your Dr
releases you at MMI… that light duty will stop. You will be
expected to find a job within your restrictions. WC doesn’t go on
forever, neither does the light duty. That’s not the job you were
hired for, they don’t have to keep you in it at the same pay rate.
