Does that mean you’re fully healed and don’t need any more rehab?
Workers comp does NOT pay pain & suffering. Any settlement for future medical bills and permanent disability, don’t happen, until there’s a pretty good idea what your future medical bills will be related to this injury, or how serious your permanent disability is.
Once all the medical stuff is done, any “settlement” would usually be within six months.
There is no mandatory time frame for any settlement to a WC claim,
WC is about paying benefits, not settlements. The default
”settlement” would be weekly payments/benefits based on the PD
rating you may have due to any partial permanent impairment due to
this injury, and access to future medical care based on necessity.
If there is no PD, there would be no award of indemnity… you may
be offered a stipend for your inconvenience and consideration to
drop any further claim for this injury… you would likely see a
demand for voluntary termination when that happens too. Don’t
expect too much if any PPD/impairment as a result of a soft tissue,
non surgical injury. You’re going to return to work, have access to
medical if necessary and the “system will have worked as intended”
for you.
I have been in the system for 3 years now I have reached MMI PNS and have seen a QME, how long after that will I hear of some type of settlement offer? and do I receive back pay for lost wages? because the first year they did not pay me workers comp payments I had to apply for state disability.
