cannot tell a IC when to report for work, or when to leave, you
cannot tell them how to perform the job, or what tools to use. You
cannot pay a &#039;employee&#039; with a 1099 for tax purposes... you best
get your employee status handled before you try to avoid workers
compensation issues. IF these folks were independant contractors...
they would NOT need YOU to negotiate a wage for them with their
&#039;employers&#039;... the people needing the home health care services. IF
you are acting as an &#039;agent&#039; for these presumed &#039;contractors&#039;, self
employed individuals...YOU are in the position of paying taxes on
the commissions you earn.</description>

Regarding that form - you can have them sign whatever you want, but you CANNOT &quot;opt out&quot; of the law.  The law in Ohio says, you MUST have workers compensation for any employees.  If your subcontractors don&#039;t have workers comp in place, then YOU are responsible for their benefits - even if you don&#039;t have a policy.   So it&#039;s silly to not have a policy, which, btw, in Ohio, you have to buy from the state.  

Go to the agent that does the rest of your business insurance.   Any independent agent can handle this for you.  Even the bonding - although if it&#039;s a license bond, you&#039;ll need the city/state bond form to provide to the agent.  If not, you&#039;ll need to tell them which TYPE of bond you want - there are hundreds.</description>
