Hi Does anybody know I fell and hurt my back and have been out on Worker’s comp?
and I have asked my job for a settlement. They have agreed on a settlement. Now I am unsure of if I want to leave my job. I think I should get a note from my doctor getting a release to go back to full duty. Do you think they will fire me if I stay and not get a settlement now?
If I was your employer, I would wonder why the change of heart…and not rehire you.

NO! Do not allow them to FORCE you back to full duty ahead of time! It could cost you your settlement.
You need to talk to your attorney about this. If you don’t have an attorney, GET one!!! FAST!!!!!!!!!!!!!!!
If i was your employer i would be very thankful i don’t have to pay my portion of the workman’s comp settlement.
does this settlement let them off the hook for future medical bills related to the injury? I work with a woman who had fallen at her previous job years ago. She took the workmans comp then returned to work upon feeling better when everyone else told her to get an attorney. She now has severe medical problems that have developed from the original fall 10 years ago.

doen’t make any offer to settle unless they are self insured. You
should be dealing with the carrier and claims adjuster, not your
employer. You haven’t provided enough details to tell what a
settlement may consist of, or whether or not you are eligible for a
cash settlement, you cannot force the carrier or employer to pay
you a lump sum to close this claim. A cash payment would likely
include a voluntary termination. Discuss your options with a
competant WC attorney. Not good idea to look for legal advice on
any message board.
