Have pneumonia, dr. note says stay home in bed 1 week, work won’t let me.?
I was diagnosed with pneumonia a few days ago. My doctor said it was very serious and put me on an antibiotic and Prednisone. He immediately faxed my boss a note explaining that I am not able to work for one week. My boss is refusing to let me miss any work. He said I cannot take any days off, and if I do, I will get a written warning for dismisal. I was off work from approximately March 2010 to the end of April 2010 for rotator cuff surgery….which was by the way, a work comp injury. They have been punishing me every since! Is there any sort of law to help me. I am really, really sick; and I’m just afraid it’s going to get worse. Need help.

If you don’t have any available sick days or personal days then your boss might have somewhat of a point. If your work has an hr dept is talk to them.
If your that sick I would contact my doctor and he may hospitalize you and they can’t fire you legally for that but if they were to you could sue them. You should contact your local labor board and find out what you can and can’t do about this. They shouldn’t be as you say punishing you for being injured especially on a wc case. Talk to your lawyer about this and see what they advise you on it. Hope all goes well and you get better. Pneumonia is very dangerous and it can kill so your health is more important than the job really but I do know that you have to make a living too.
You are stuck in a bad situation. Unfortunately, most states do not have laws that prevent you from being fired because you are sick unless you are hospitalized. If there’s any bright side to this, maybe your boss will come down with pneumonia after you drag yourself to work – drop by his office to talk with him.
take your meds exactly as directed, keep your inhaler and nebulizer handy, wash your hands better, and see your HR manager.
this sort of thing is happening to a lot of people. i would not want to work for a man such as your boss. i do understand people have to. you could draw unemployment if he fires you. contact the labor board. you are too sick right now, to even have to be thinking of all this. it is not worth it. you must take care of yourself and do as doctor says, or it could get worse. seek another job when you feel better even if you are not fired, i kindly suggest. who wants to work for someone who wants you to come in with pneumonia?
Your doctor does NOT control your employers policies. Nor whether
or not the employer must provide time off. If you are eligible for
unpaid leave under FMLA, your employer must provide that
information and the forms. Other than FMLA, there are no job
protections. There is no law that says your employer must give you
the time off.(besides FMLA)
