Has anyone had surgery on work comp?

Has anyone had workers comp offer you a settlement after surgery without getting a lawyer. I am not planning on getting one, but I have been told that sometimes they just offer a settlement. Is that true?
I have a torn meniscus in my knee and they are going in to do surgery on it. I am worried about a lawyer because I really enjoy my job and don’t want to jeopardize it.

  1. yes a lot of time they will offer you a settlement basically to keep you from getting a lawyer. It won’t neccesarly be workers comp but the company who you worked for. Most of the time it’s nothing when you sit down and think about it. Will you be able to work after the surgery? Will they cover your medical bills after the surgery? Most of the time Not. My mother once settle for $1000.00 for her finger…it was never fixed properly and it still (16 years later) crooked and has no feeling in it. Just if you decide to settle without a lawyer ask many questions and make sure that you can live with the decision. HOpe it helps. Good Luck.

  2. Yes, most work comp carriers will try and offer you a settlement after you have surgery. I don’t know the extent of your work comp injury, but they offer a settlement so that you can’t come back 6 months from now or even 2 years+ from now saying you still hurt, the surgery didn’t fix whatever the problem is, etc. My best advice is to get a lawyer if your work comp injury was serious enough. You might want to discuss the situation with your doctor, too. He might be able to give you insight if you may or may not have problems in the future with your work comp problem. You can also maybe get a free consultation with a lawyer just to see.

  3. The carrier can and likely will make an offer to close the claim.
    Settlements are based on your PPD/impairment rating, that is
    provided after you complete treatment, and reach a stable
    condition…MMI. You should not consider any offer to settle the
    claim until you have been rated. And determine IF there is need for
    future medical treatment. IF you take money for medical, you will
    be paying out of pocket for any additional treatment you seek. You
    canNOT use your own health coverage for treatment to your claimed
    work injury.
