Does anyone know if AFLAC covers workman’s comp issues?

My husband got injured at work, but his employer was saying that it is not workman’s comp. They forced him to take a unpaid leave of absence until his claim can be settled. We had to get a lawyer. It was months before the hearing. It was proven to be workman’s comp, but now he has to have surgery. We have AFLAC, but are not sure if we would get any assistance since it was in fact workman’s comp. He hasn’t been able to work and we have been struggling for a few months. We hadn’t thought about our AFLAC policies. Can we do a claim for his surgery if it is a workman’s comp issue?

  1. Gem

AFLAC is supplemental insurance and as such, I believe you can apply and get benefits no matter WHY you are off work or no matter WHO else pays.

Just call them, they will be happy to help you.

  2. Speak to an AFLAC agent and be prepared to give them your husband’s policy # ( his is the only policy that would cover his injuries).
It would be rare for AFLAC to pay while your husband is out on Worker’s compensation if he is being compensated by the workers compensation insurance carrier.
You could make a claim for his lost time not covered by workers compensation just as long as you have found a doctor that says he needed to be out of work.

But speak to an AFLAC representative – they’ll know exactly what your policy covers.

  4. I was injured at work recently and it is a workmans comp claim. Workmans comp paid for everything even the deductibles but I spoke to aflac and my rep told me that they will still pay me even if workmans comp already paid. They pay for each doctors visit inc the emergency room. They even pay me for getting crutches and a knee brace. I should also get paid for the surgery and for the broken bone and dislocation so in short the answer is YES call your agent ASAP

  5. NO… your own health coverage does NOT cover the cost of medical
care to a work injury. Read the EOC/Evidence Of Coverage pages,
usually at the back of the policy, work injury is specifically
exclused from all personal health coverage policies. The
employer/WC carrier is liabile for the cost of medical care, not
you. Kevin C… get that in writing…if you let the WC carrier
pay, and you are also reimbursed by AFLAC…you are DEFRAUDING the
insurance company, and it is illegal. That, or you simply don’t
know what youre’ talking about. farmgirl…you CANNOT be paid in
excess of what the WC statues provide. If that is 66% of gross
wages… even IF AFLAC or another STD/LTD carrier would
cover…they will take an offset to the max rates in the coverage.
You CANNOT DOUBLE DIP, regardless of the insurance you may have.
GEM… READ the EOC of the policy…you are mistaken and
    misinformed on this.
