From what I’ve heard. It’s based on individual situations so get ready for a down pour of answers that are all very different. I’d just ask L&I. One answer and it’s gonna be the right one.
IT ALL DEPENDS ON THE BODY PART THAT WAS INJURED. CHECK WITH A WORKERS COMP LAWYER IN YOUR AREA. MY HUBBY BROKE HIS BEARING ARM AND HAD TO QUITCONSTRUCTION AND GOT RETRAINED AND GOT A SETTLEMENT BUT IT WAS SOMETHING HE COULDN’T DO WITH ANY OTHER BODY PART. CONSULT SOMEONE SO U DON’T GET TAKEN. HOPE THIS HELPS
Settlements are based on ‘after’ condition having exausted all treatments….if there is still a percentage of disability, then that is what they base the settlement on.
WOW the misunderstandings of the WC system. When you suffer an
industrial injury, your benefits consist of wage replacement while
your Dr says you cannot work, you receive medically necessary
treatment to your injury, and recover, and IF there is permenent
disability/impairment DUE TO the injury… there is indemnity, or
continuing payments made based on the rating. Rehab is a additional
benefit, IF you are unable to return to your preinjury profession,
or to help with job placement, or indentify your transferrable job
skills. If there is PD… then indemnity is due. That is NOT based
on or dependent, or reduced on your eligiblity for vocational
rehabilitation benefits.
