do you think i will get fired for suing my job for workers comp denial?

What is going on? i was hit by another co-worker took 1 wk off -for injury, my assaulter is out 1 wk too? why?
when i returned to work she took a whole week off. i asked my manager why and she said its not at all related to our incident? is she a LIAR? why wont they tell me the truth? this cantbe a coincidence and she had already taken her vacation and used up all her sick days prior to her hitting me in my back?

my manager is a total biatch– when i asked her why she said dont go by her u want to stay out of trouble. EXCUSE ME! im the victim here the girl hit me at my desk when i had my back turned-i didnt lay one hand on her. i never go by her to begin with but i just wanted to know cuz if this girl retaliates on me i should be prepared since my job wont protect me by firing her from HOSTILE WORK ENVIRONMENT

  2. When someone hits you, that’s called assault. Police come, arrest the assaulter and charge her with a crime.

    Press charges. You employer can’t stop you.

  3. Your manager is right. It’s best you stay out of this one. Don’t ask any one why the other worker was out. It might have been a family emergency, as far as you know.
    Just keep your distance from the other worker. If any more hitting happens, press charges. Make sure to have as many witnesses as possible (if you have any idea it might be coming), regardless, make a LOT of noise if it does. That will attract attention and the witnesses. Remember, also if you get hit, go down and stay down. Then have someone call in the manager and 911. Make them, not the manager take it from there. File the report.
    Sounds like you have no union to help out. So, cover your own assets. :)

  4. If you were not injured in this altercation, you don’t have a valid
    WC claim. A Dr must certify eligibility for any WC benefits. Your
    employer must inform you if you are eligible for leave under FMLA,
    if not, there are no job protections. Regardless… for you to be
    paid any wage loss under WC a Dr must certify. If your employer
    provides sick leave, paid time off, or vacation, you can use that
    to replace any wage loss. If you simply decide on your own to take
    the time off, you aren’t likely to be paid for any wage loss. You
    have a good rant going here, but what appears to be unfair isn’t
    always illegal. If you don’t like your options, discuss the merits
    of your claim with a attorney. Message board isn’t a good
    substitute for legal advice. WHY?…because there are always three
    sides to any scenario…yours, theirs, and the way things actually
    ARE. Based on the info you provide here…you have no claim for WC
    benefits. Your employer may terminate any time without cause or
    reason.
