Can you work a job during a( NY State) workers comp case?

I am currently waiting for a decision on a workers comp case for a settlement. It is for partial disability so that I cant work manual labor or the same type of work because my injury. My lawyer said that whatever I make from a job can be deducted from the settlement amount. He said whatever I can provide on my own makes this company that much less liable. This job that I might get is a job consisting of sitting all day so there isnt any manual labor. Is this true that I cant work until the comp case is settled or is my lawyer just being extra safe?
No, if you actually read what I am writing is that I was hurt on the job and no longer work there. I am going after them because the forced me out by sending me hours away to do light duty when it was obviously not neccassary. I said I can do a job sitting all day because my back is still injured but I am not going to let the company get away from having me be injured on their time and try to get rid of me because I probably cant do physical work again. It has been a year since I lifted stuff and I am still in pain, so learn to read before you are so judgemental. You sound like you work for an insurance or rather my last employer.

  2. If you do any work while your case is pending you could lose the case AND your job for fraud.

  3. By the way you are stating the question, your lawyer wants you to get as much money as possible by not working at all, and you feel that you can work and suppliment your income with a small salary.

    What do you want to do? Can you work, but want to pretend like you can not? Is that the way you see it?
