Can you explain to me how workers comp works in this situation?

I hurt my back almost 2 months ago at work. My claim has been denied. I have been to the company doc who just pushed around on my back and shoulders and says that it is only a strained muscle in my back. The pain has been through my shoulders, neck and back. Sometimes my upper back locks up on me. I would like to get a second opinion before I decide if I want to fool with fighting the claim or not. The specialist said they will not become physician of record. Also if I file workers comp they wont accept my insurance later. So I am wondering if I file on my insurance and later my claim is approved what happens if I need surgery (though I hope not!!) or something else along those lines? Would the insurance than go after workers comp? or would I be expected to pay out of pocket at that point? Since the specialist wouldn’t be physician of record and it wouldn’t be paid through workers comp would the results not be “evidence” of my injury? Sorry if this does not make since.

  1. depends on your state’s laws re: worker’s comp
    if you tell the new doctor that you hurt yourself at work, he/she cannot file on your health insurance.
