Can I sue my work because i hurt my back bad lifting a box?
I was at my job and i lifted a box that was heavy and i hurt my back. Now im out of work for a while while i heal…can i sue my work place?

    Not unless you filed an accident report and it should have gone through workmans compensation where they would have immediately sent you to a doctor. If you didnt, how are you going to prove you hurt it at work?

  2. Can you sue? Sure you can. The question should be though would you win. The answer to this is maybe but it’s doubtful.

    Why is it doubtful? You lifted the box. End of story.

  3. Did they force you to lift the box? Did you lift it improperly? Did you know it was heavier than you should try to lift on your own?

    If they didn’t require you to lift the box or refused you equipment to lift it correctly, then why sue because you made a poor judgment call and chose to lift (or try to lift) something that was too heavy for you?

    Unless you’ve left out some of the story, I fail to see why the issue is their fault and thus why they should be required to compensate you for injuring yourself.

My husband hurt his shoulder 3 years ago at work and waited a week to tell anyone…he still got workers compensation and at the end of it all he got a 40,000 dollars settlement (plus he got 325 a week up until that). I say file an incidnet report at work RIGHT NOW. Find a good workers comp lawyer…you can get moner for thins I never though of..like mileage for traveling to and from doctors appointments, any money you pay out of pocket for prescriptions..all your doctors appointments will be covered under workers comp. But yeah get on it asap

  5. No, its your fault that you picked up a box that was to heavy in the wrong way. Ive worked for many places that we were required to move very heavy boxes, they have to show you the correct way to hold a large box so that you dont hurt yourself. Why should the company be reliable if you picked something up that was to heavy?

  6. Did you notify your supervisor at the time of the accident???
    If you did, then your injury is covered by workman’s compensation and you don’t have to do a thing. If you did not, then you are in violation of the Worlkman;s compensation aws and have no groundfs to sue.

    You see, Workman’s comp is ” no fault” but you do have some obligations, such as notifiying your empoyer immediately, no matter how slight the injury. If you follow the rules, ( which are posted in the workplace) there is no reason why you need a lawyer.

  7. NO NO NO you cannot sue your employer. You file a first report of
    injury, the employer files with their WC carrier, and you are
    provided medical treatment and wage replacement benefits. Filing
    the WC claim is your exclusive remedy for work injury. You can only
    sue the employer in civil court if they are not legally insured.
