Can a union file a grievance for a worker’s compensation case?
Light duty is available, employee had been working the light duty job for 6 months, then decided to stop working. Compensation has not been given to employee because company doctor states employee is able to work light duty.
Then no, If the worker decided to stop working even thought he was told he can work, the union can’t do anything. The employer didn’t do anything wrong. They offered light duty work.
Unless the employer is violating a provision in the CBA/contract,
no there is no grevience ability. Union has virtually NO INPUT in a
comp claim.
