Can anyone tell me how compensation is calculated in a Workers Comp. Case in ohio?
I had a shoulder injury at work resulting in a torn rotator cuff, torn tendon, and impingement syndrone. I had surgery on my shoulder about a year ago and now i got hurt in a car accident while working (truck driver) it was re-injured, which requires another surgery. I’ve already been off work 2 months and the Dr. tells me that after this next surgery I’ll probably be off another year and may never be able to do my “skilled trade” again. workers comp is now pending because of my previous surgery can this be denied?
Also in my current job i had to go through a medical approval to be hired which i passed should that not count towards anything?

  1. Worker’s comp won’t pay anything toward the new “re-injury” or offer retraining as the second injury wasn’t work related. I wonder why they haven’t settled your case yet.

Who was responsible for the auto accident. Was it you or another party? Are you insured for medical and auto? Was the other party insured? Were you the driver or passenger. Sounds like you’ve got a serious injury on your hands and possibly a major lawsuit. If you can give more info, I can give you my opinion.
