Bulging disk for workman’s comp? Need solid advice…?

Hello all.Was wondering if I am able to get workman’s compensation for a bulging disk in the L3-L4 region of my back.I’m a TRUCKER and first started noticing the pain about 3 months ago.Been driving for about 5 1/2 years straight with only 4 days off a month,if that.
I was actually getting 2 CT scans due to pain in my front left area which I was thinking more of a ulcer or colon issue.My gastrologist said the CT scans came back with no issues in the colon and stomach area but did notice I have a bulging disk.I filed for workman’s comp with Liberty Mutual but have NOT heard anything back yet!? I’ve been out of work for 2 weeks now because I can not drive while on pain meds (ultram) and waiting on Liberty Mutual to do something.Do I have a solid case?

  1. You have to report an injury on the day that it happens in order for your company to submit a claim for Work mans Comp. You cannot tell them after the fact, it doesn’t count. Report it, get a lawyer and never settle on the case so they pay your medical bills from your injury for life.

  2. You don’t file a claim with the carrier, you are not the insured
    party. YOu file a injury report with your employer, THEY file a
    claim with their IC and it will be investigated. You need
    supporting medical evidence, provided by your treating physician to
    support your claim of industrial injury. You’re gonna have to let
    this play out… and expect a denial to your claim for WC benefits.
    If/when that happens, you’ll have to go to court and litigate the
    issues.
