Are Anxiety, Depression and Panic Disorder considered valid Workers Comp Injuries?

I was with my previous employer for 1 year prior to suffering from an axiety attack and developing severe depression. I was promoted within my 1st 4 months of hire and did not receive substantive training to properly perform my new position- therefore I started having migraines and sleeping issues due to stress. I requested additional training and informed my superiors of the issue but they blatantly disregard the matter until it was too late (which just so happened to be 8 months later). I had an anxiety attack at work and was then placed on WC by my employer whom stated I experienced a work related injury. But then I was terminated 3 days afterwards for “NO CALL NO SHOW”. I now have an attorney and am living with anxiety and depression. My previous employer denied the claim and stated they were not the cause of my stress. Can someone give me advice on how to handle my case? I guess the main question I have is how they can deny my WC claim when they were the ones who placed on the WC in the first place.

  1. It would help if you had a statement from the professional who is treating you saying it was the cause of your stress.
    It really depends on the laws in your state. In some, anxiety and depression are not reasons to be on worker’s comp.
    And if it helps you any, it’s very common for employers to deny workers comp claims. That’s what the attorneys are for.

  6. You don’t have to handle your claim…you have an attorney, let
    him/her handle the claim. your employer has no ability to deny the
    claim…once they file with their carrier, the claims adjuster
    deals with your attorney.
