Anyone denied short term disability?
I have Degenerative Disc Disease. I filed a workers comp claim here in Ohio. I was denied, them stating the fact that it is a non-allowable condition under the states laws. I then filed for short term disability from University Hospitals, my employer. I was also denied, them stating that my surgeon claims it is work related. How do I get paid for this time off? All my hearings with BWC have been disallowed. My attorney wants to file a civil claim with the short term disability company. What should be the next step? I am trying to feed 3 kids on NO income for the past 8 months and just had the TLIF spinal fusion surgery and can’t return to work for ATLEAST 6 more months. Ready to lose house and other financial issues!
Since I have no income, I did qualify for medicaid. I am a single mom of 3, and medicaid has paid for my surgery, which was $64,000!! Thank God!! Thanks for the input!
Check with your local Medicaid office. Sounds like you have a workmen’s compensation issue, but you may have to file an appeal to get it resolved. Perhaps get some legislators involved if nothing else changes. But while you get that processed, see the medicaid office and your town offices for help.
Medicade is not going to pay weekly wage replacement benefits. You
have an attorney, that is where your questions should be directed.
You’ll have to wait for the appeal through the BWC, or the civil
action your atty is suggesting. Whether or not your injury is work
related will be resolved through the hearing process. You should be
aware however that DDD is not a industrial injury. DDD happens over
time, and just as the definition is… degenerative disease. YOu
don’t “get” this from performing your job duties. HOWEVER… The
condition caused by DDD can be aggreviated by injustrial injury…
performing the job duties associated with your employment. And THAT
should be/is compensable. So, again, you’ll have to let this play
out through the litigation process. And, you’ll need substantive
medical evidence to support your claim…whether to WC benefits, or
STD/LTD. In the meantime, you should apply for SSDI/Social Security
Disability Ins benefits. Go to the SSA office, or http://www.ssa.gov for
